Terms & Conditions

For purposes of these Terms & Conditions the words “you,” “your,” “passenger” & “cardholder” refer to each person who books/purchases/receives goods & services arranged through Absolutours. The words “Absolutours,” “our” & “we” refer to Shanks Inc., o/a Absolutours and its authorized representatives.

Option date

Booking may be placed on 48 hours option without any payment, except on some tours. We have the right to cancel any booking on option at anytime without notice. Once a payment has been applied to a booking, change/cancellation fees apply.


Unless otherwise stated (UOS), prices are per person, for land only, in Canadian currency, and are based on two adults sharing one hotel room/cabin. UOS, children prices are restricted to those 2-5 years of age at the time of tour completion and only when sharing a room with two adults.
Please note that credit card processing fee of 3% of the total cost will apply on train journeys, and on air tickets. Prices may differ due to season and exchange rate.
Prices are subject to increase even if a booking has been paid in full due to factors such as, but not limited to, exchange rate, taxes, & airport/airline fees. Prior to tour, if the total price of the package is increased and the cumulative increase is more than 7%, then you have the right to cancel the contract & obtain a refund. Note: This does not apply if the increase is the result of an increase in PST, GST, or other taxes such as airport, hotel, etc. Should you be required to pay increased taxes locally, you are responsible for them. All prices in brochure valid only until March 31st, 2014.

Tour Inclusions & Extras

Please refer to the respective itinerary for inclusions. Charges such as, but not limited to, inbound/outbound flight, excess baggage, airport & departure taxes, passport & visa fees, monument entrance fees not stated in the respective itinerary, camera fees, travel insurance, personal incidental charges, meals not stated in the itinerary, beverages, phone calls, internet charges, laundry, gratuities, bellman, room service, housekeeping, optional excursions, shopping, security, agricultural and customs fees, all personal expenses and charges for services not listed in the respective itinerary is your responsibility. Tipping is at your discretion. It is recommended to tip motor vehicle drivers, guides, restaurant servers, operators of rides such as elephant, camel, rickshaw puller etc.


For land bookings made more than 60 days prior to tour departure date: non-refundable deposit of $500 per person per tour is required at time of booking and full payment is due 60 days prior to tour departure date. For land bookings made 60 days prior or less to tour departure: full payment is required at time of booking. Additional non-refundable deposit may be required and final payment due date will be 110 days prior to tour departure date in the event of customized itinerary, suppliers such as but not limited to Taj Hotels, and Oberoi hotels & resorts, train journeys, busy travel season such as Christmas/New Year period, Pushkar Cattle Fair, limited availability, etc. Non-refundable deposit required for the train journeys is 50% of the train costs.
Your payment for deposit and/or final payment indicate your compliance with our booking conditions, whether or not you have actually signed the appropriate draft. Verbal authorization of the use of your credit card confirms your reservation.

Changes & Cancellations

Any changes/corrections (including name correction) to a reservation once payment is applied will be considered as cancellation and cancellation charges will apply in addition to the new tour prices, even if we do not have full payment on file.
Land Cancellation charges are as follows:
Until final payment due date - Full deposit
Post final payment due date - 100% of total price
Additional land cancellation charges will apply in the event of customized itinerary, suppliers such as but not limited to Taj Hotels, Oberoi hotels & resorts, train journeys, busy travel season such as Christmas/New Year period, Pushkar Cattle Fair, etc.
International and / or domestic airline tickets / flights
For packages that involve air tickets/flights, cancellation charges in addition to ones stated above will apply whether or not we have received full payment.
You are fully responsible for, but not limited to, land cancellation charges, transfers, accommodations, meals, and all other costs that arise due to, but not limited to, modification/cancellation of airline reservation by the airline, other cancellations / interruptions for any reasons, including weather conditions, sickness, natural disaster, riots, etc. There are no refunds for any unused services, including but not limited to, meals, accommodation, sightseeing, and transportation. We may arrange for the resale of any holidays you cancel without refund to you. In an event where major services (that is, tours) are cancelled by us, we will have no responsibility beyond the refund of monies received by us for such cancelled services, which will be deemed to constitute full settlement of any claim you might have against us for the cancellation.

Travel documents

It is solely your responsibility to obtain, at your own expense, all the documentation required by relevant government authorities for the purpose of your trip. Required documentation may vary depending on citizenship status. Special documentation may be required for minors (under the age of 18 years) travelling alone or with one parent and/or for children who have a different surname than the adults who accompany them.
A valid Canadian passport is required for Canadians citizens intending to visit India. The passport must be valid for at least six months beyond the date of your expected departure from India. Canadians citizens must also be in possession of a visa. Some states/provinces within a country require a special permit in addition to the required visa for that country. A transit visa may also be required. Prior to booking, you must check with the relevant consulate(s) about what documentation is required and for up-to-date information.
Entry to a country may be refused even if the required information and travel documents are complete. A previous criminal record could be an obstacle in international travel. We cannot be held responsible for denied boarding and entry under any circumstances.
Electronic tickets (e-tickets) will be sent approximately 21 days prior to your tour departure. Please review the e-tickets for accuracy. E-tickets must be presented along with proper identification & documentation at airline/hotel/train check-in and for other purchased services.

Health Requirements

Some countries require proof of inoculation and/or vaccination certificate. This must be present until tour completion. Please consult your travel agent, Public Health Agency of Canada [http://www.phac-aspc.gc.ca] and/or the concerned consulate for details.

Travel Insurance

It is mandatory for all clients to obtain travel insurance up to minimum $250,000CAD in medical coverage when travelling with Absolutours. This coverage must insure personal injury, medical expenses, repatriation expenses and evacuation expenses. All clients are required to provide proof of insurance purchase and adequate coverage as per the required amount if requested by the group leader or company representative. You agree that we shall not be responsible or liable for events such as, but not limited to, cancellation, interruption, schedule change, accommodation & meal expenses for interruption/disruption, baggage & personal, and health problems that may arise or become aggravated while travelling or at your destination. Standards of medical care may differ from those in Canada. Treatment may be expensive, payment in advance may be required and provincial health care coverage may not be available or be limited.
When clients obtain travel insurance through Absolutours, clients acknowledge that they are satisfied with the levels of insurance arranged by Absolutours. Where the client has declined insurance from Absolutours, the client acknowledges that the cost of the tour does not include insurance, and that the client must obtain separate coverage at additional cost. When obtaining travel insurance through a source other than Absolutours, the client must ensure the insurer is aware of the type of travel being undertaken. We highly recommend you to buy full travel insurance.


Flights & Carriers: All flight times, flight itineraries, carriers and aircraft types are subject to change with or without notice. You are responsible for costs arising due to flights & carriers change/cancellation. It is your responsibility to confirm flight times. It is recommended that you arrive at the airport 3 to 4 hours prior to departure to allow sufficient time for check-in and security clearance. Please check with the airline directly for their check-in cut-off time. Carriage and service performed and tickets issued are subject to the terms referred to on such tickets, and other applicable rules. You agree that we cannot be held responsible or liable for expenses, lost wages or missed vacation time due to flight time changes, delays, and/or cancellation. Tour may still operate as scheduled in the event of flight delay / cancellation and it is your responsibility to join the tour at your cost. You will not be reimbursed for unused portion of the tour. Itineraries do not include International airfare.
Airline Baggage Allowance
Flight baggage allowance varies by airline and routing, and is subject to change at anytime without notice. Please note: flight baggage allowance for travel within a country may be lower than international travel allowance. Please check with the airline prior to departure for the most up-to-date regulations in order to avoid items being confiscated at security. All baggage remains at your own risk throughout the trip.
Land reservation baggage allowance
One suitcase with a maximum weight of 23 KG and dimensions not exceeding 77.5 cm x 56 cm x 32 cm (30.5” x 22” x 12.5”) is allowed on vehicle transportation


Complimentary one inbound and one outbound transfer will be provided on Indian land tours based on the following conditions:
a. We have been provided inbound & outbound flight details at least 21 days prior to your inbound date
b. You must stay at a hotel booked by us on the night of your arrival and the night prior to your departure and have booked one of our land tours.
c. In the event of flight delay the transfers will be deemed cancelled with no refund and you must make your way to/from the tour hotel.
d. All transfers may be based on group transfers. Group transfers operate at scheduled times. Passengers must arrive/depart with enough time to clear customs and minimum check-in time required by the respective airline for departure transfer.
For eligible complimentary one inbound and out outbound transfer, an Absolutours representative at the destination airport location will greet you. Please be careful to identify the Absolutours representative. It is not uncommon to be approached by people misrepresenting themselves.
Passengers arriving or departing outside group transfer times or passengers who have booked a pre or post tour accommodation may purchase a transfer through Absolutours or make their own way to/from the tour hotel.
No refund will be given for any unused transfers. Transfers cannot be routed to other pick-up / drop-off points other than those booked.
Transfers costs for all extensions are additional.

Hotel / Cabin / Categorization of tours

Rating/categorization is based upon our opinion and may vary from official rating. Our rating is based on many factors including location & facilities.
All guests who want to check-in/out other times than specified hotel check-in/out times, may be required to pay locally additional charges that the hotel may impose upon them.
When more than two adults are sharing a hotel room, a cot may be provided depending upon availability & is subject to additional local charges.


Booking on request may take up to 7 business days. We cannot be held responsible if any of your specific request cannot be fulfilled, or if local surcharges are applied on any goods or services.

Facilities & Services

We reserve the right to curtail or alter packages with or without notice. This may be due to, but not limited to, for circumstances beyond our control such as monument closure, hotel overbooking, unexpected maintenance problems, road/weather conditions, etc. This may result in advertised facilities / services being modified or unavailable. This may also lead to major changes such as change of destination, change of departure or return by more than 24 hours, change of itinerary, change of transportation mode/type, hotel, ship or accommodation standard. In these circumstances, we reserve the right to substitute hotels/tour and other arrangements without notice or liability. We will try to advise your travel agent of any description changes, if known, prior to departure.
You agree that we shall not be held responsible or liable if, due to the acts or omissions of others, some services, bonus features or facilities described in this brochure or on our website, cease to be available or are not working. The cancellation of services for any reason is beyond our control.
Any photographs & descriptions in the brochure and website are for your information only and are not guaranteed to be an exact representation.
No refunds or adjustments will be made to you for portions of your vacation not taken or used. Local excursions/optional tours purchased are non-refundable even if not used.
You agree that we shall not be responsible or liable for any loss, damage, illness or injury you may suffer as a result of different living standards and practices at the place of destination.

Absolutours Representative & Problem Handling

For land reservations, upon arrival at destination Absolutours representative will give you a welcome briefing and provide important information about your travel arrangements. If you have any questions, queries or problems while at your destination, please contact Absolutours local representative and/or hotel/cruise/train directly. Failure to report your concerns may preclude your right to a claim.

Force Majeure/Act of God

Absolutours is not responsible or liable for changes or cancellations made that relate to or arise as a result of hostilities, acts of war or threat of war, riots, civil disturbances, terrorist activity, industrial disputes, natural and nuclear disasters, fire, epidemics or health risks, technical problems with transport as well as flight delays and other events beyond our control.


For Indian tours, you may be required to pay locally additional 25-200 INR or greater for picture camera fees and 25-400 INR or greater for video camera fees for each monument. Please note, these fees are subject to change at anytime without notice.
We reserve the right of use of photo/videography during the operation of our tours and use them for marketing purposes in any form. Should you wish not to be part of it, please advise us in writing prior to tour ticket issuance.

Notice of Claims

You must notify Absolutours, in writing by registered mail, of any claim you may have, or claim to have, against Absolutours, within 30 days from the event giving rise to the claim. Should you not file a written complaint with Absolutours within 30 days from the end of your vacation, you will be presumed to be satisfied with the services received and to have waived any and all claims that you may have had against Absolutours.
You may not commence any legal proceeding against Absolutours unless you have submitted a notice as set out above. Under no circumstances shall Absolutours be liable to you for an amount in excess of the total amount paid to Absolutours for your vacation.

Applicable Law

Regardless of your holiday destination, any dispute between you and Absolutours shall be subject to the laws of the province of Ontario, Canada.
Notice: no agent or representative of Absolutours or any other service provider has the authority to modify or waive any provision of these Terms and Conditions.

Absolutours Responsibility

The travel services provided are subject to the Travel Industry Act (ON).
Absolutours makes arrangements with suppliers who provide travel services such as air travel, cruises, hotels, buses, sightseeing, car rental or other activities included in your booking. The travel services are subject to the conditions imposed by these suppliers, and their liability may, in turn, be limited by their tariffs, conditions of carriage and international conventions and arrangements. Absolutours does not own, manage, operate, or control any vehicle, hotel, resort, cruise ship, restaurant, or other supplier of services, and is not responsible for their acts or omissions.
All baggage and personal effects are at all times and in all circumstances at your own risk. Baggage Insurance is recommended. The carriers, accommodation and other suppliers providing services are independent contractors and are not agents, employees, servants or joint ventures of Absolutours


You, and each person travelling in your tour and named in the booking form expressly acknowledge as follows:
1. That you understand the nature of the touring activities being undertaken (“touring activities”). You are qualified, in good health, and in proper physical condition to participate in such touring activities, and are in possession of the required documents to participate in the same. You further agree and warrant that if at any time you believe conditions to be unsafe, you will immediately discontinue further participation in touring activity undertaken.
2. You fully understand that (a) touring activities involve risk and danger , which could be of serious natures (“risks”); (b) these Risks and dangers may be caused by your own actions or inaction’s, the actions or inaction’s of others participating in the touring activity, the conditions in which the touring activity takes places, by acts of the third parties, or by way of an accident; (c) there may be other risks and social and economic losses either not known to you or not readily foreseeable at this time; and you fully accept and assume all risks and all responsibility for losses, costs and damages you incur as a result of your participation or that of the accompanying minor in the touring activity.
3. You, on behalf of yourself and on behalf of your accompanying touring participants/family members hereby release, discharge, and covenant not to sue absolutours and its affiliates, their respective administrators, directors, agents, officers, members, volunteers and employees, other participants, any sponsors, advertisers and, if applicable, owner and lessors of premises on which the touring activity takes place, (each considered one of the “releasees” herein) from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence of the “releasees” or otherwise, including negligent rescue operation and you further agree that if, despite this release and waiver of liability, assumption of risk, and indemnity agreement to you, or anyone on your behalf, makes a claim against any of the Releasees, you will indemnify, save, and hold harmless each of the releasees from any litigation expenses, Legal fees, loss, liability, damage, or cost which may incur as the result of such claim.


We may use your personal information to review and improve the tours and services that we offer, and contact you by mail, e-mail, telephone, or fax about other tours and services offered by us.
